Terms of Service

This agreement was written in English (US). To the extent any translated version of this agreement conflicts with the English version, the English version controls.

Definitions
Site: The3DSite.com website or any approved branded domain names pointing to the Site.
Service: Any service provided by Sellers including but not limited to 3D Design, Graphics, CAD, Animation, Video Creation, Scanning, Printing, Engineering
Product: Uploaded files that are offered for free or purchase, or any physical product.
Seller: Member who is providing Services or products on the Site.
Buyer: Member who is purchasing Products or Services on the Site.
User or Member: any person who creates a user account on the Site.
Public: any person who visits the site who is not logged in or any Search Engine crawling the site.
Content: any material published at the Site including but not limited to wire files, models, textures, plugins, video games, video game modifications, motion files,
collections, packages, materials, scripts, shapes, custom UI skins, tutorials, frequently asked questions, words, music, films, images, software, code, posts and any other information.
Contract – an agreement between Buyer and Seller according to which the Seller performs a service for the buyer at a pre-agreed fee.
Admin: Member who has administrative privalidges

Subscriptions:
Monthly subscription packages may change from time to time based on features or due to changes in commission structures.
You will be notified ahead of time if your current plan will be impacted.

Payments:
The site uses Paypal for all transactions including monthly subscriptions and product purchases on the Site. If a Seller chooses to charge for services directly on the site, then those purchases
will be done through our payment engine as well. Otherwise payments for services wil be agreed upon between Buyer and Seller for Services rendered.
We do not store any Credit Card information on the Site nor do we take payments directly on the site. For payments you are directed to a paypal page in order to pay with your paypal account or Credit Card.

Commissions: Depending on your subscription plan, there are different commission structures and payouts for Products sold. Some plans are immediately split, other plan payouts are per month, while others are based on certain dollar amounts.
Please refer to your subscription plan details for specific details. Our goal is to provide Sellers the highest percentages for Products sold including minimizing Paypal and Credit Card fees.

Store Owner Payments: In order to accept payments from buyers, Store owners selling products must have a Paypal account and provide API credentials to the Site for automated processing. In the event, a store owner decides not to
provide necessary API credentials, then checks can be mailed out accordingly. Checks will take longer to process and have a higher dollar threshold for payments. Details for setting up your Store Front for electronic payment can be found on your Store Admin page.

Ownership of Products: Sellers, Creators and Designers maintain all rights and ownership of uploaded Products and software unless otherwise indicated by Seller

Usage Rights: In general, all downloaded Products can be used by Buyer and cannot be resold by Buyer unless agreed upon by Seller.


Statement of Rights and Responsibilities

Privacy

Your privacy is very important to us. We designed our Data Policy to make important disclosures about how you can use The3DSite.com to share with others and how we collect and can use your content and information.

Sharing Your Content and Information

You own all of the content and information you post on The3DSite.com, and you can control how it is shared through your privacy and application settings. In addition:
For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission, subject to your privacy and application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with The3DSite.com (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
When you use an application, the application may ask for your permission to access your content and information as well as content and information that others have shared with you. We require applications to respect your privacy, and your agreement with that application will control how the application can use, store, and transfer that content and information. When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of The3DSite.com, to access and use that information, and to associate it with you (i.e., your name and profile picture).
We always appreciate your feedback or other suggestions about The3DSite.com, but you understand that we may use your feedback or suggestions without any obligation to compensate you for them (just as you have no obligation to offer them).

Safety

We do our best to keep The3DSite.com safe, but we cannot guarantee it. We need your help to keep The3DSite.com safe, which includes the following commitments by you:
You will not post unauthorized commercial communications (such as spam) on The3DSite.com.
You will not collect users' content or information, or otherwise access The3DSite.com, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.
You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on The3DSite.com.
You will not upload viruses or other malicious code.
You will not solicit login information or access an account belonging to someone else.
You will not bully, intimidate, or harass any user.
You will not post content that: is hate speech, threatening, incites violence or gratuitous violence.
You will not use The3DSite.com to do anything unlawful, misleading, malicious, or discriminatory.
You will not do anything that could disable, overburden, or impair the proper working or appearance of The3DSite.com, such as a denial of service attack or interference with page rendering or other The3DSite.com functionality.
You will not facilitate or encourage any violations of this Statement or our policies.

Registration and Account Security

The3DSite.com users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:
You will not provide any false personal information on The3DSite.com, or create an account for anyone other than yourself without permission.
If we disable your account, you will not create another one without our permission.
You will not use The3DSite.com if you are under 13.
You will not use The3DSite.com if you are a convicted sex offender.
You will keep your contact information accurate and up-to-date.
You will not share your password (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might jeopardize the security of your account.
You will not transfer your account (including any Page or application you administer) to anyone without first getting our written permission.
If you select a username or similar identifier for your account or Page, we reserve the right to remove or reclaim it if we believe it is appropriate (such as when a trademark owner complains about a username that does not closely relate to a user's actual name).

Protecting Other People's Rights

We respect other people's rights, and expect you to do the same.
You will not post content or take any action on The3DSite.com that infringes or violates someone else's rights or otherwise violates the law.
We can remove any content or information you post on The3DSite.com if we believe that it violates this Statement or our policies.
If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.
You will not use our copyrights or Trademarks or any confusingly similar marks, except as expressly permitted by our Brand Usage Guidelines or with our prior written permission.
You will not post anyone's identification documents or sensitive financial information on The3DSite.com.


Mobile and Other Devices

We currently provide our mobile services for free, but please be aware that your carrier's normal rates and fees, such as text messaging and data charges, will still apply.
In the event you change or deactivate your mobile telephone number, you will update your account information.
